The Committee on Migrant Workers

The Committee on Migrant Workers (CMW) is composed of 14 independent experts. It monitors the implementation of the provisions of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (ICRMW). Being a latecomer among the UN treaty bodies, the Committee held its first meeting in March 2004.

Members are elected for a term of four years by States parties and serve in their personal capacity. They may be re-elected if nominated. The Committee normally meets once a year in Geneva for three weeks.

Individual Communications

There is no individual complaint actually possible before of the Committee. This will be possible as soon as 10 States parties will accept this procedure according to Article 77 of the Convention. As at 1 March 2008 no State party had made this declaration. When the procedure of individual communications will be effective, the communications are accepted only if:

• the same issue has not been or is currently not considered before another international authority
• all domestic possibilities of recourse have been exhausted
