Main Rights Protected by the ICRPD
The ICRPD protects the rights and dignity of persons with disabilities. Among others, the Convention contains the following rights:
- Prohibition of discrimination on the basis of disability and guarantee of equal protection to persons with disabilities (article 5);
- right to the full enjoyment of life on an equal basis with others (article 10);
- equality of rights and advancement of women and girls with disabilities (article 6);
- equal rights for children with disabilities: they shall not be separated from their parents against their will, except when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child. In no case shall a child be separated from parents on the basis of a disability of either the child or one or both of the parents (article 23);
- equal rights for persons with disabilities to own or inherit property, to control their own financial affairs and to have equal access to bank loans, mortgages and other forms of financial credit (article 12);
- prohibition of medical or scientific experimentation without the consent of the participating person (article 15);
- equal access to primary and secondary education and to vocational training (article 24) and
- right to employment and to gain a living (article 27).
