Droit à une personnalité juridique  

Le droit à une personnalité juridique est consigné dans l'article 6 de la Déclaration universelle des droits de l'homme.

En cas d'atteinte de ce droit fondamental (voir ici),

Toute personne peut s'adresser aux organes/institutions suivants:

Comité des Droits de l’Homme (si le protocole facultatif est ratifié par l'Etat.)

Rapporteur spécial sur l’indépendance des juges et des avocats.

Les migrants (et les travailleurs migrants) peuvent s'adresser au:

Rapporteur spécial sur les droits de l’Homme des migrants - et au

Comité pour la protection des droits des travailleurs migrants et des membres de leur familles

Les populations autochtones peuvent s'adresser au:

Rapporteur spécial sur la situation des droits de l’homme et des libertés fondamentales des populations autochtones.

Dans le cadre d’une privation de liberté non reconnue par l’Etat :

Comité des Disparitions forcées- ou au

Groupe de travail sur les disparitions forcées

Les personnes se trouvant dans un pays d’Afrique peuvent s'adresser à la :

Commission ou Cour africaine des droits de l’Homme et des peuples

Right to a person before the law

The right to a person before the law (subsumed in the right to fair trial) is enshrined in Article 6 of the Universal Declaration of Human Rights.

In cases of violations of this human right (explained here),

All persons may turn to the these organs/institutions:

Human Rights Committee (if the optional protocol is ratified by the state)

Special Rapporteur on the independence of judges and lawyers

Migrants may turn to:

Special Rapporteur on the human rights of migrants

Migrant workers may turn to:

Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families 

Indigenous people may turn to:

Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people

In the case of a deprivation of liberty not recognized by the State :

Committee on Enforced Disappearances

Working Group on Enforced or Involuntary Disappearances 

Persons being in an African country may turn to:

African Commission or Court on Human Rights and Peoples’ Rights
